  • Certificates of Occupancy (COOs): In June 2024, Gov. Kevin Stitt signed Senate Bill 1635 (2024) that adjusts the requirements for commercial medical marijuana license applications and final product testing. Read more details about these changes in SB 1635 (2024). The following addresses licensees who are required to hold a Certificate of Occupancy (COO), have not received a COO, but applied for one before Feb. 1, 2024. An Attestation of Application for a Certificate of Occupancy is now available.
    • If you submitted an OMMA commercial license application and submitted a full and complete application for a valid Certificate of Occupancy (COO) to the appropriate governing authority before Feb. 1, 2024, complete this attestation and upload it to OMMA's Contact Form at omma.ok.gov/contact to correct the lack of a COO in your submission. Be sure to complete the form in its entirety.
    • If your application has been rejected and you are in the resubmission window, complete this attestation and upload it to your licensing portal application within 30 days of your rejection notice.
  • New State Laws: In June 2024, Gov. Stitt signed three new state laws that adjust the requirements for commercial medical marijuana license applications, employee credential processing and final product testing. Read more here.

  • National fingerprint background checks: A new attestation form along with the state background check will temporarily meet the national background check requirement included in HB 2095 (2023). All persons of interest and Transporter Agents must upload:
  • OBNDD registration deadline: All Oklahoma medical marijuana businesses must possess a valid OMMA commercial license and an active OBNDD registration to possess or handle medical marijuana or medical marijuana product. The deadline for OBNDD's annual registration is Oct. 31. Commercial licensees who fail to meet this requirement by Nov. 1 will be required to cease business operations and lose access to the Metrc statewide seed-to-sale tracking system. Change of Ownership

Licensee Death, Foreclosure, Receivership, Insolvency, or Bankruptcy

Step 1 — Stop and stabilize immediately

  • Do not let family/friends start “handling product” informally.
  • Do maintain normal security and inventory controls.
  • Do identify who is legally authorized to act (this will be the key).
     

Step 2 — Determine who will have legal authority

Choose the applicable authority route:

  • Probate estate: court order appointing a personal representative (for example, letters of administration).
  • Trust: trustee authority documents.
  • Court action: receiver order if applicable.

OMMA will require these “official documentation” items be submitted.
 

Step 3 — Email ommacertificateofauthority@omma.ok.gov

Tell OMMA:

  1. the name and license number of the commercial license for which you seek a temporary Certificate of Authority (“COA”)
  2. the name, email address, and phone number of the person who seeks to receive the temporary COA
  3. if the owner has died, the name, date of death, and death certificate of that person
  4. you need a temporary COA from OMMA so you can lawfully manage operations temporarily
    • COA is what allows temporary continuation of operation without a separate OMMA license while the estate or business stabilizes or winds down.
       

Step 4 — Apply for COA (See OMMA Rules OAC 442:10)

Provide OMMA:

  1. Documents establishing proof of identity:
    • Electronic copy or digital image in color of one of the following unexpired documents: (1) Front of an Oklahoma issued driver's license or Real ID; (2) Front of an Oklahoma Identification Card or Real ID; (3) A United States Passport or other photo identification issued by the United States government; (4) A tribal identification card approved for identification purposes by the Oklahoma Department of Public Safety; or (5) Other documentation that the Authority deems sufficient to establish identity.
  2. If applicable, a list of all owners and principal officers of the applicant and supporting documentation, including, but not limited to: certificate of incorporation, bylaws, articles of organization, operating agreements, certificate of limited partnership, resolution of a board of directors, or other similar documents.
  3. Documents establishing the applicant, the members, managers, and board members, if applicable, and documents establishing seventy-five percent (75%) of the ownership interests are Oklahoma residents.
  4. A criminal background check conducted by the Oklahoma State Bureau of Investigation establishing that the applicant does not have a disqualifying criminal conviction.
  5. A receiver, personal representative, or trustee must provide the Authority with the following information:
    • Official documentation proving that the person is the legal trustee, receiver, or personal representative for the business, or otherwise has legal authority over the operation and/or disposition of assets of the licensee, such as a court order, letters of administration, or other official documentation as required by the Authority. Any further documentation the Authority determines is necessary to ensure the secured party is qualified under Oklahoma law and this Chapter.
  6. If the applicant for the COA is already licensed by OMMA, submit an affidavit provided by OMMA related to the applicant’s current license(s).
  7. Agreement to follow the same restrictions/obligations as a commercial licensee (see OAC 442:10-5-1.1 of the OMMA Rules).
     

Step 5 — Term

  • A COA is valid for 60 days.
  • OMMA may renew the COA upon sufficient proof, as determined by OMMA, that more time is necessary to allow for the orderly disposition of the business.
  • A COA may not extend beyond the expiration date of the underlying license regardless of the issue date.
  • Upon termination or expiration of the COA, all medical marijuana or medical marijuana products in the custody or possession of the holder of the COA must be disposed of or liquidated in accordance with Oklahoma statutes and OMMA Rules.

If continuing the business long-term:

  • After receiving a temporary COA, applicant prepares and submits license transfer application.

If closing:

  1. Submit voluntary surrender form to OMMA
  2. Send photo copy of ID to OMMA
  3. Lawfully waste all remaining marijuana and/or marijuana products
     

Step 6 — Restrictions

  • Do not transfer product/business control without OMMA approval. Doing so is a serious enforcement risk.
  • The Authority may revoke or refuse to issue or extend a Certificate of Authority for any of the reasons that the Authority may revoke or refuse to issue or renew a license under Oklahoma law or these Rules.
     

Foreign Financial Interest Attestation

State law requires growers, processors, dispensaries, labs and transporters to submit a Foreign Financial Interest Attestation form with the Oklahoma Bureau of Narcotics and Dangerous Drugs Control (OBNDD) within 60 days of approval of an OMMA business license application. Pursuant to 63 O.S. § 427.15(B), failure to complete the attestation within 60 days will result in the revocation of your OMMA license.

Visit the OBNDD website to fill out the form. A separate attestation is required for each business license. For example, if your business owns a grower license and a processing license, you must complete an attestation for the grower license and a separate attestation for the processing license, each one within 60 days of OMMA approving the license application.
