OMMA's current rules went into effect July 11, 2026.
The permanent rules implement legislative changes from the 2025 legislative session, including HB 2807, SB 518, SB 774, SB 1039 and SB 1066. Additionally, permanent rules include amendments made to July 12, 2025 emergency rules.

Public Comment
The public comment period for OMMA's proposed permanent rules began on Monday, Dec. 1, 2025, and closed at 5 p.m. Wednesday, Jan. 7, 2026.
During the public comment period, there was a publicly available form to collect comments and an in-person meeting held on Jan. 7 at 9 a.m. in Room 535 of the Oklahoma State Capitol (2300 N Lincoln Blvd.). View a recording of this meeting here.
OMMA issued an Agency Rule Report after the public comment period. In all, OMMA received and responded to 147 comments (128 written and 19 verbal) from patients, businesses and the general public.
Rulemaking Process
Oklahoma’s medical marijuana statutes are the foundation of OMMA’s regulatory and licensing authority, including OMMA's rules. Oklahoma voters approved the original version of those statutes with State Question 788 in 2018.
New state laws prompt the rulemaking process. Some new laws are incorporated into the rules on a temporary, emergency basis. Permanent rules must be approved by the Legislature and signed by the Governor before taking effect. Administrative rules have the effect of law.
Rulemaking involves an extensive public comment period. Licensees receive information about the rulemaking process, including public comment and hearing opportunities, in newsletters and other notices sent to email addresses associated with patient and commercial licenses.
